Terms of use

These Terms tell you the rules for using this Wild Night Out website and the various Wild Night Out social media sites (i.e. Facebook, Twitter and Instagram) (together referred to as the ‘Sites’). Please read them carefully. 

By using the Wild Night Out Sites, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use the Sites.

We may need to update the terms from time to time so it’s a good idea to come back and read them regularly to stay up to date. You may wish to print off a copy for your own reference.

1. Who are we?

a. Wild Night Out was founded by explorer Belinda Kirk in 2016. After 20 years of taking people of all ages into the wilderness Belinda understands first hand the positive impact that adventure can have on people's lives. Wild Night Out was conceived to spread Belinda’s passion for adventure and make it accessible to all.

b. The Wild Night Out Sites are operated by Ordnance Survey, a company registered in England and Wales (company registration number 09121572) whose registered address is at Explorer House, Adanac Drive, SOUTHAMPTON, SO16 OAS (referred to in these Terms as OS, we, us and our).

c. OS is Geat Britain’s mapping agency. One of OS’s major campaigns is #GetOutside, which is  designed to inspire people to ‘get outside’ and enjoy the Great British outdoors and to make outdoor activity more enjoyable, accessible and safe.

d. Belinda and OS are delighted to be collaborating with each other on Wild Night Out and bringing their expertise and passion to this venture.

3. Other Terms which apply

These terms of use refer to the following additional terms, which also apply to your use of our Sites:

a. Our Privacy Policy, which describes how we collect, use and look after any personal data that we collect from you, or that you provide to us, as part of the Wild Night Out registration process and otherwise when you use our Sites. Please take a moment to read our Privacy Policy so you know what choices you have about the information you may provide to us or which we may ask you for.

b. Our Cookie Policy. Our Cookie Policy provides information about the use of cookies in our Wild Night Out Sites and how you can control and delete them. ‘Cookies’ are little files that websites put on your computer to make visits quicker, easier and more relevant.

We also have a set of Frequently Asked Questions to help explain more about Wild Night Out and how you could get involved.

4. Using our Sites

a. Our Sites are made available free of charge, on an ‘as-is’ basis. We do not provide any guarantees or warranties as to their availability, accuracy, completeness or performance.

b. We cannot guarantee that the Sites will always be available or be uninterrupted. We may have to suspend, withdraw, discontinue or change all or any part ofthe Sites without notice and whilst we will always try to notify users of downtime in advance, we will not be liable to you if for any reason the Sites are unavailable.

c. We reserve the right to suspend or permanently block any user’s access to our Sites, at any time, if we reasonably suspect that such user is in breach of these terms.

d. We may add or remove content, functionalities or features on our Sites at any time.

e. Although we have taken reasonable steps to ensure that the information on the Sites is correct, it is possible the information may contain errors, or be incomplete, or out of date. We therefore make no representations, warranties or guarantees (express or implied) regarding accuracy, completeness or currency of the information.

f. The content on our Sites is provided for general information only. It is not intended to amount to advice on which you should rely. We therefore disclaim all liability and responsibility arising from any reliance that you or anyone else places on such content and you should obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content we provide.

5. Intellectual Property Rights

a. The names Ordnance Survey, OS and Wild Night Out, and the OS and Wild Night Out logos are UK registered trade marks of OS and Belinda Kirk. You are not permitted to use them without our express written approval.

b. In addition to the trade mark registrations mentioned above, (but with the exception of the User Generated Content (see below), OS and Belinda Kirk are the owners or licensees of all the intellectual property rights in the Sites, and in the material published on them. These works are created by copyright laws and treaties around the world. These terms set out what you can do as far as copying and using the materials published on our Sites. All other rights are reserved.

c. You may print off one copy and may download extracts of the Wild Night Out welcome pack and any other pages of our Sites for your own personal use. You must not modify the paper or dital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio material or graphics separately from the accompanying text. The status of OS, Belinda Kirk, and that of any other identified contributor, as the authors of content on our sites must always be acknowledged. You may not use part of the materials on our Sites for commercial purposes without obtaining a licence or other express written permission from us.

d. If you print off, copy, download or reproduce any part of our Sites in breach of these terms of use, your right to use our Sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

6. User Generated Content

a. If you make use of a feature that allows you to upload content to our Sites (referred to as User Generated Content), or interact with other users of our Sites, such User Generated Content (or interaction) shall not include any of the following:  

i. Material which is illegal or promotes illegality;

ii. Misleading information;

iii. Material which is threatening, abusive, offensive or indecent;

iv. Defamatory material;

v. Material which breaches copyright or any other intellectual property rights;

vi. Advertisements;

vii. Personal information about you or a third party; or

viii. Material which contains a virus or other harmful component.

b. You warrant that any User Generated Content does comply with the above standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

c. You view and use all User Generated Content at your own risk. We do not warrant its accuracy or reliability and any views expressed in any User Generated Content are those of individual contributors and not necessarily those of OS or Belinda Kirk.

d. We are not responsible for any User Generated Content, but we may vet it and we may remove or edit any User Generated Content at our entire discretion. If you wish to complain about information and materials uploaded by other users please contact us on getoutside@os.uk.

e. We do not claim copyright in any User Generated Content but by posting it you grant us a royalty-free, non-exclusive licence to display, reproduce and distribute the User Generated Content on the applicable Wild Night Out Site. You may revoke this licence at any time by removing your User Generated Content or, if removal is not permitted by the relevant Site by contacting us.

f. We have the right to disclose your identity to any third party who claims that any User Generated Content submitted by you constitutes a violation of their intellectual property rights.

7. Linking

a. You may link to our Sites provided that you do so in a way that is fair and legal and does not damage the reputation of OS or Belinda Kirk, or take advantage of it.

b. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

c. You must not link from any website which is not owned by you.

d. You must not establish a link in any way that is likely to give your users the impression that our content is yours.

e. Our Sites must not be framed on any other site, nor may you create a link to any part of our Sites other than the home page.

f. The website you link from must not contain content that is illegal or indecent, or infringes any intellectual property rights or other rights.

g. We reserve the right to withdraw linking permission without notice.

h. If you wish to link to or make any use of content on our site other than that set out above, please contact getoutside@os.uk.

i. Any third party websites we link to are outside our control and we accept no responsibility for their content or for the products or services they provide.

8. Disclaimer and Limitation of Liability

a. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

b. Subject to paragraph 8(a), we do not warrant that our Sites or the servers that make them available are free from viruses or bugs. It is your responsibility to implement any procedures and virus checks to satisfy your own requirements.

c. Subject to paragraph 8(a), we exclude to the maximum permitted by law:

i. all conditions, warranties, representations and other terms (whether express or implied by law); and

ii. any liability for any loss or damage incurred by any user (including any loss of data, loss of profits, reputation or goodwill, anticipated savings, business, or losses suffered by third parties), whether direct, indirect, special, incidental or consequential, even if foreseeable, and whether caused by tort (including negligence), breach of contract or otherwise.

9. Governing Law and Jurisdiction

a. These terms are governed by English law and the English courts have the exclusive jurisdiction in respect of any disputes arising.
